These Terms and Conditions (“Terms”) govern your access to and use of emberxivy.com and any purchase made from Ember x Ivy.
By accessing this website, placing an order, or purchasing a product from Ember x Ivy, you agree to these Terms.
Please read them carefully before completing a purchase.
1. About Ember x Ivy
Ember x Ivy is an online retail brand operated by an individual proprietor in Trinidad and Tobago.

References in these Terms to “Ember x Ivy”, “we”, “us” or “our” mean the individual operator trading under the Ember x Ivy name.
Ember x Ivy is not represented as a corporation, limited liability company or separate legal person.
2. Adults Only
Ember x Ivy sells intimate wellness products intended exclusively for adults.
You must be 18 years of age or older to use this website for the purpose of purchasing products.
By placing an order, you represent that you are at least 18 years old and legally capable of entering into a contract.
We reserve the right to cancel an order where we reasonably believe that the purchaser is under 18 or that a product is being purchased for a minor.
Products must be stored responsibly and kept away from children.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, specifications, features, colours and other information presented on our website are accurate.
However:
- product colours may appear differently depending on screen or lighting conditions;

- manufacturers may make minor changes to products or packaging;

Nothing on our website should be interpreted as a medical, therapeutic or health claim unless expressly stated otherwise.
4. Product Safety and Responsible Use
Our products are intended for lawful adult personal use.
You are responsible for reading and following any instructions, warnings, cleaning directions and charging guidance supplied with the product or displayed on its product page.
For your safety:
- inspect products before use;
- do not use a product that appears damaged, cracked, swollen, excessively hot, defective or otherwise unsafe;
- use only compatible charging equipment where applicable;
- do not modify, dismantle or attempt unauthorised repairs;
- clean and store products appropriately;
- do not share intimate products unless they have been specifically designed and hygienically prepared for such use;
- discontinue use if a product causes unusual pain, irritation, injury, numbness, allergic reaction, excessive discomfort or other unexpected symptoms; and
- seek appropriate medical advice where you have a health concern or are uncertain whether use of a product is suitable for you.
Where a product is described as waterproof or water-resistant, follow the specific rating and care instructions applicable to that product.
5. Not Medical Advice
Products, descriptions, articles, FAQs, social-media content and other information provided by Ember x Ivy are for general consumer information only.
They are not intended to:
- diagnose, treat, cure or prevent any disease or medical condition;
- replace professional medical advice;
- provide reproductive, sexual-health or mental-health treatment; or
- represent that a product is a medical device unless expressly stated.
If you have a medical condition, injury, implanted medical device, pregnancy-related concern, unusual pain or other health concern that may affect use of an intimate product, you should seek advice from an appropriately qualified healthcare professional.
6. Orders
Placing an order through our website constitutes an offer to purchase the selected products subject to these Terms.
An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted the order.
We may refuse or cancel an order before fulfilment where reasonably necessary, including where:
- an item is unavailable;
- a price or product description contains a genuine error;
- payment cannot be verified;
- delivery information is incomplete or appears incorrect;
- we reasonably suspect fraud or misuse;
- the order appears to have been placed by a minor; or
- fulfilment would be unlawful or unsafe.
If an online payment has already been collected for an order that we cancel, the applicable amount will be refunded.
7. Availability
All products are subject to availability.
Displaying a product on the website does not guarantee that it remains in stock.
Inventory may occasionally become unavailable after an order has been submitted because of simultaneous purchases, inventory errors, damaged stock or other circumstances.
If we cannot fulfil an order, we will contact you and provide an appropriate refund for any amount already paid for the unavailable item.
8. Prices and Currency
Customer-facing prices are displayed primarily in Trinidad and Tobago Dollars (TTD).
Online Debit and Credit Card payments are processed through PayPal in United States Dollars (USD).
Where online card payment is selected, the applicable USD amount is displayed at checkout for transparency.
Your bank, card issuer or PayPal may apply its own currency-conversion rate, foreign-exchange spread, international transaction fee or other charge. Such third-party charges are outside the control of Ember x Ivy.
Cash on Delivery payments are payable in TTD unless otherwise stated.
We reserve the right to change prices prospectively at any time. A price change does not alter an order that we have already accepted, except where necessary to correct an obvious pricing error and the order has not yet been fulfilled.
9. Payment Methods
Available payment methods may include:
- Debit or Credit Card through PayPal;
- PayPal; and
- Cash on Delivery.
Availability of a particular payment method may depend on the order, location or technical availability of the relevant payment provider.
Card information submitted through PayPal is processed by PayPal and is subject to PayPal’s applicable terms and privacy practices.
Ember x Ivy does not intentionally store complete customer payment-card numbers or card security codes.
10. Cash on Delivery
Where Cash on Delivery is selected, payment becomes due upon delivery.
Customers should ensure that:
- the delivery information supplied is accurate;
- someone capable of accepting the order is available where required; and
- the applicable payment amount is available upon delivery.
We reserve the right to restrict or withdraw Cash on Delivery for customers who repeatedly place orders and refuse delivery without reasonable cause.
11. Delivery
We deliver within Trinidad and Tobago to locations supported by our delivery arrangements.
Any delivery timeframe communicated by Ember x Ivy is an estimate unless expressly guaranteed.
Delivery may be affected by matters outside our reasonable control, including traffic, weather, courier delays, incorrect addresses, inability to contact the recipient, public holidays or other disruptions.
You are responsible for providing a complete and accurate delivery address, telephone number and any necessary delivery instructions.
We are not responsible for delays or failed deliveries caused by materially incorrect or incomplete information supplied by the customer.
12. Free Shipping
Where Ember x Ivy advertises Free Nationwide Shipping, eligible orders will not be charged Ember x Ivy’s standard delivery fee.
Free-shipping promotions may be subject to the delivery areas and conditions stated on the website at the time of purchase.
We may change or discontinue promotional shipping offers prospectively. Any shipping arrangement already confirmed as part of an accepted order will continue to apply to that order.
13. Discreet Packaging
We package orders with discretion in mind.
Where reasonably practicable, external packaging will not identify the intimate nature of the contents.
Some information may nevertheless have to appear on delivery documentation, payment records or communications where required for fulfilment, security, payment processing or law.
14. Change-of-Mind Returns and Hygiene
Due to the intimate nature of the products we sell, change-of-mind returns are generally not accepted, particularly where:
- packaging or a hygiene seal has been opened;
- a product has been used, worn, tested or inserted;
- a product has come into intimate contact with the body;
- packaging has been materially damaged by the customer; or
- the product cannot reasonably be resold for hygiene or safety reasons.
This hygiene policy applies only to returns arising from a change of mind or similar non-defect reason.
Nothing in this section removes or limits your statutory rights where goods are defective, unsafe, materially different from their description, not of merchantable quality, or otherwise give rise to rights that cannot lawfully be excluded.
15. Defective, Damaged or Incorrect Products
If you believe that an item:
- arrived damaged;
- is defective;
- does not correspond materially with its description;
- is not of merchantable quality;
- is an incorrect item; or
- otherwise gives rise to a statutory right to redress,
please contact support@emberxivy.com as soon as reasonably practicable.
Include:
- your order number;
- a description of the issue; and
- photographs or video where reasonably appropriate and where doing so does not require unsafe use of the product.
Do not continue using a product that you reasonably believe is defective or unsafe.
Depending on the circumstances and applicable law, an appropriate remedy may include a refund, replacement, repair or other lawful redress.
The fact that a product is an intimate item does not remove statutory rights relating to defective or non-conforming goods.
16. Returning a Product for Inspection
Do not send an intimate product back to us without first contacting customer support.
Where inspection is reasonably necessary, we will provide appropriate instructions for handling or returning the product.
Products returned for inspection should, where reasonably possible, be:
- cleaned and handled hygienically;
- securely packaged;
- accompanied by identifying order information; and
- returned in accordance with the instructions provided.
Where a product is confirmed to be defective or otherwise subject to a lawful remedy, responsibility for reasonable return or inspection costs will be determined in accordance with applicable law and the circumstances of the claim.
17. Refund Processing
Approved refunds for online card payments will ordinarily be returned through the original payment method where reasonably possible.
Banks and payment processors may require additional processing time after a refund has been initiated.
Refund amounts relating to online card payments may be affected by the way PayPal, the customer’s bank or card issuer processes foreign-exchange conversions. We do not control third-party exchange rates or fees.
Cash on Delivery refunds may be processed using a reasonably available method agreed with the customer.
18. Misuse of Products
To the fullest extent permitted by law, Ember x Ivy is not responsible for loss, damage or injury caused by:
- deliberate misuse of a product;
- use contrary to supplied warnings or instructions;
- modification, tampering or unauthorised repair;
- use of a visibly damaged or defective product after the defect became apparent;
- use with incompatible equipment, accessories, chargers, chemicals or substances;
- improper cleaning or storage;
- use by a person under 18;
- use for an unlawful purpose; or
- conduct that no reasonable user of the product would regard as an intended or appropriate use.
Nothing in this section excludes liability that applicable law does not permit us to exclude.
19. Limitation of Liability
Nothing in these Terms is intended to exclude or restrict:
- liability for death or personal injury resulting from negligence where such liability cannot lawfully be excluded;
- liability for fraud or fraudulent misrepresentation;
- rights concerning title, description, merchantable quality or fitness for purpose that applicable consumer law makes non-excludable; or
- any other liability or statutory right that cannot legally be excluded or restricted.
Subject to the above and to the fullest extent permitted by applicable law, Ember x Ivy will not be responsible for indirect, incidental, special or consequential losses that were not reasonably foreseeable as a result of the transaction.
We are also not responsible for losses caused solely by matters outside our reasonable control, subject always to any rights or remedies that applicable law provides.
Any limitation or exclusion in these Terms applies only to the extent that it is lawful and reasonable to do so.
20. Personal Responsibility
Purchasers are responsible for deciding whether a product is appropriate for their intended lawful personal use.
A customer’s awareness of these Terms does not mean that the customer assumes risks which applicable law does not permit Ember x Ivy to transfer or exclude.
However, customers remain responsible for consequences arising from their own deliberate misuse, unlawful conduct, failure to follow clear safety instructions, or unauthorised alteration of a product, to the extent permitted by law.
21. Website Use
You may use emberxivy.com only for lawful personal purposes.
You must not:
- attempt to gain unauthorised access to the website or its administrative systems;
- interfere with the operation or security of the website;
- introduce malware or malicious code;
- use automated systems to abuse checkout, inventory or ordering functions;
- submit fraudulent orders or payment information;
- impersonate another person;
- use the website to facilitate unlawful activity; or
- reproduce substantial parts of the website for commercial use without permission.
We may restrict access or cancel orders where we reasonably believe the website is being misused.
22. Intellectual Property
The Ember x Ivy name, branding, logo, website design, original written content, graphics and other material created for the brand are protected to the extent provided by applicable intellectual-property law.
Third-party product photographs, trademarks and materials remain the property of their respective owners where applicable.
You may not reproduce, distribute or commercially exploit Ember x Ivy’s original branding or content without permission.
23. Third-Party Services
The website relies on third-party services that may include:
- PayPal;
- web-hosting providers;
- WordPress;
- WooCommerce;
- email providers;
- delivery providers;
- Meta, Facebook and Instagram; and
- other technology providers.
Those services operate under their own terms, policies and technical systems.
We are not responsible for an independent third party’s acts, omissions, outages or processing practices except to the extent that applicable law makes us responsible.
24. Privacy
Use of personal information is governed by our Privacy Policy, which forms part of the website’s overall terms of use.
By placing an order, you acknowledge that information necessary to process payment, fulfil the order and arrange delivery may be provided to relevant service providers in accordance with that Privacy Policy.
25. Force Majeure and Events Outside Our Control
We will not be responsible for delay or failure to perform an obligation where performance is prevented by circumstances genuinely outside our reasonable control, such as:
- severe weather;
- natural disasters;
- widespread utility or telecommunications failures;
- civil disturbance;
- government restrictions;
- transportation interruptions;
- major payment-provider outages; or
- comparable events beyond our reasonable control.
This provision does not remove any rights that applicable law gives to a customer where an order cannot ultimately be fulfilled.
26. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where legally permissible.
The remaining provisions will continue to apply.
27. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived the right to enforce it later.
28. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, operations, payment arrangements or applicable law.
The Terms applicable to an order will ordinarily be those published on the website when the order was placed.
The effective date at the top of this page will be updated when these Terms are materially revised.
29. Governing Law
These Terms and purchases made through Ember x Ivy are governed by the laws of Trinidad and Tobago, subject to any mandatory consumer rights that apply.
Any dispute arising from these Terms or an order may be brought before the courts or other competent authorities of Trinidad and Tobago.
Nothing in these Terms prevents a consumer from making a complaint to the Consumer Affairs Division or exercising any other right of redress available under applicable law.
30. Statutory Consumer Rights
These Terms are intended to operate consistently with the laws of Trinidad and Tobago.
Nothing in these Terms is intended to exclude, restrict or misrepresent any right that a consumer has under applicable law, including rights relating to:
- ownership and title to goods;
- conformity with description;
- merchantable quality;
- fitness for an applicable purpose;
- defective or unsafe products; or
- remedies which the law requires to remain available.
Where any provision of these Terms conflicts with a mandatory legal right, the mandatory legal right will prevail.
